It was not designed for common use.

Reinhold Burger was the first to register the vacuum flask as a trademark, despite the fact that he was the inventor. Later, James Dewar sued the Thermos company but sadly, lost the court case.

Due to Thermos’ promotion of their product and lack of diligence in protecting their trademark, a judge ruled in 1962 that thermos with a small ‘t’ could be used generically. However, the capitalisation of ‘Thermos’ belonged exclusively to the company.
